Prestige Capital Partners provides an intermediary service between Project Owners, Employees of Project Owners, Investors (herein “Clients”) to Financial Providers/Service Providers (herein “Funders”, “Financial Providers”, “Financial Institutions”, “Lenders, “Deal Promoters”).

Prestige Capital Partners act as an introduction company and as such, only work within the introducing capacity. Nothing in these pages constitutes as financial, legal or any kind of advice. Users should consult a suitably qualified financial advice firm and lawyer before undertaking any investment or financial offer.

By visiting the Website as a User; are engaging in Prestige services for information including all Third Party Service Providers. You, as a User agree that information will be collected and handled as described in this document under the Terms and Conditions. If you wish to take on our services, Prestige is governed by the laws in Hong Kong (HK) and responds to those laws. If there is any conflict between us, this legal document will govern. Any dispute over privacy, is subject to this Legal Document that you agree to on taking our services including its applicable limitations on damages and the resolution of disputes. The Terms includes all legal documents incorporated by reference into this Policy which includes Privacy, Disclaimers and Code of conduct herein.

Prestige Capital Partners Ltd (HK) 2290958 is a registered company through the HK registrant body.  Prestige Capital Partners is not authorized or regulated by the HKSFC, SEC or Financial Services Authority under the Financial Services and Markets Act 2000 (“FSMA”). This Website provides general information about Prestige and nothing contained in the material constitutes a recommendation or solicitation for the purchase or sale of any security or investment by Prestige herein. Customers understands that Prestige does not provide legal and/or tax advice and are not responsible for advising them on the laws pertaining to his/her transaction.

1.4 Risk Warning

All investments carry an element of risk, which may stem from their illiquidity, leverage, investment horizon and general risks associated with investments. These risks may include; capital loss , dilution of shareholder value, that dividends will not be declared, and illiquidity risk due to the absence of a viable secondary market for a particular product.

The value of investments may rise or fall due to the volatility of world markets, interest rates or changes in the rate of exchange for the currency in which the investment is denominated. Some investments can experience significant volatility and value fluctuations in a very short space of time, which may present an increased risk of losing your original capital.

Project Finance

Prestige Capital Partners is not a Funder and we do not promise to be able to fund projects. We are not held responsible our Funders non performance as we are only project introducers. It is Project Owners responsibility to do the due diligence and seek legal representation before entering any Financial Deal or Obligation.

Prestige as an introduction company, facilitates calls and mail regarding the funding procedure with Project Owners and presents your project to specifics of Funder requirements. Often we may need to collaborate with other agents (herein “Intermediaries”) to help facilitate project finance to a suitable Lender. We try to limit the amount of agents therein.

1.5 AML/TF and Solicitations

Prestige Capital Partners shall comply with laws and regulations related to the prevention of Money Laundering and Terrorist Financing. Our group works alongside many financial institutions who have the appropriate framework to prevent such activities and are “risk based”.  Our policies, procedures and internal controls are designed to address the risk of money laundering. Our Banking and Financial Group is likely to carry out full due diligence (KYC) on their customers and risk assessments which may involve co operation with Security services.

Due Diligence

As part of any due diligence process, Prestige Capital Partner Third Parties might collect data from third party sources to support any due diligence process. This is in reference to any Financial Provider who offers Prestige’s clients Financial support or Investments to affiliated businesses. The due diligence process involves having proper engagement and business relations and represent as a true without liability. Due diligence may require filling out a KYC/ CIS form to conform with banking rules and regulations.

Legal Forms and Documents

At times Prestige may require you to fill out legal forms such as an NCND or questionnaire documents. Please be aware that we may need these forms filled in before we can engage in any business activity.

2.0 Data Protection

Prestige Capital Partners cares about how personal information is used and shared and we are committed to respect the rights and privacy and to help to protect the security of Website Users information. Prestige shall comply with all applicable legal provisions and local laws pertaining to data protection. In particular, we shall not provide or otherwise disclose any personal data of Website Users to any Third Party without authorization from the User. Search engine bots can help measure out website ranking, by monitoring user location, browser and device (Please review our Cookie Policy) We also use Website Bot control for spam detection and hacks.

2.13 Confidentiality Obligations

How Prestige Capital Partners Uses Your Information:

Both Prestige and Website User in Agreement hereby acknowledges that by virtue of the Agreement it shall have direct or indirect access and acquire knowledge of Confidential Information from or about each other.

Each Party (hereinafter “Party”) hereby undertakes to hold in absolute confidence any and all Confidential Information and not to use, disclose, reproduce or dispose of any Confidential Information in any manner other than that expressly provided for in the TC.

Both Parties understand that information can be accessed or obtained which relate to the laws of HK, which includes but not limited to Prestige personnel and employees. Subcontractors, consultants or agents may have their own agreements in place which they will not be bound by the undertaking under this Agreement. Exempt from the duty to hold in confidence any Confidential Information that:

  • Information becomes generally available to the public other than as a result of a breach of the provisions of the TC
  • The Website is acquired or passed on to Third Party Subcontractor, consultants or Agents. We undertake the obligation to inform web users prior to take over whereby the disclosure of Confidential Information may need to be approved
  • The receiving Party (Third Party ownership or Authority) is required by law or requested by any governmental agency to disclose, providing always that the receiving Party shall promptly notify the disclosing Party of such requirement prior to any such disclosure
  • Is already known by the receiving Party at the time of its receipt (as evidenced by its written records)

2.2 Privacy of Information Collected From You

Prestige collects information from Users’ when  information is requested by Users through communications of the Website contact form. The type of information that Prestige collects depends on particular interaction with us which may include, without limitation; your Full Name, Email Address, Telephone Number, Website URL Loan/Funding Amounts, Passport information and Proof of funds and any other information are are legally ninded to such as CIS.

The Company Policy is to keep client information confidential. We maintain safeguards that comply with federal standards to protect Website User information. Third parties with whom we may share investor and entrepreneur information must agree to follow appropriate standards of security and confidentiality. Prestige’s policy applies to former, current and future Web Users.

Information collected about you and email trail will stored on our databases as long as neccessary. You can ask us to delete you information by sending us an Email. Please use the subject line “delete our data”. The exception to this rule may be in the form of compliance and investigations of outside financial/legal authorities to follow up complaints or disputes.

2.3 Marketing Channels and Disclosure

Through our aim to get projects funded, we may need to expose projects on other Website platforms. Whilst we endeavor to fund projects directly through our direct network of service providers we may need to use other platforms for Funders to acknowledge and fund your project.  We will let you know prior to advertisement if this is suitable for you. Users of these platforms could be direct Funders or other Intermediaries/Brokers. Prestige cannot guarantee privacy of your information on these Websites, in such cases we will inform you prior to submission. We also may share User information in the following circumstances (Prior notices will be given):

  • If Prestige is acquired merged with another company, it’s possible that our assets may be transferred to another company. Or in the event of bankruptcy, we may transfer the current processed information we have collected from you to the other company (if Deals have not been completed). We also may transfer our rights under any customer agreement we have with you.
  • We may have to disclose information in order to comply with the law,  judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena. We believe it is necessary to investigate, prevent, or take action regarding illegal activities. Terms could be suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.
  • To enforce our Terms and Conditions; for example, to protect the security of our Site, as required by law or when we believe that disclosure is necessary to protect our rights.
  • We may provide information about you to carefully screened entities that work on our behalf, such as our funding channel partners  Only trusted companies who require the use of said information for business purposes are given access to it.

3.0 Terms and Conditions

3.1 Using Prestige Website
Prestige Capital Partners prohibits login access from site Users and web scraping robots.  The Site Visitor is encouraged to submit a project funding request in the contact form on the contact us page. Site Visitor must represent and warrant that before becoming a Prestige Capital Partner client that:

  • All data provided by the User in the contact form is accurate and non-misleading
  • Any changes in the registration data will be reported to Prestige upon follow up communications
  • The Site Visitor does not use pseudonyms or pen names
  • The Site Visitor is at least eighteen (18) years old at the time of funding or Investment request

3.2 Our Contact via Email

Once you have submitted the required details on the contact form, you will receive an automated notification from us to acknowledge your request. We will then send another Email to you to engage in further communication and this will allow you to submit your project to us. We do not ask for Passports or Personal Identifiers – this information is to be agreed upon by yourself and the funder in question. Business is conducted from there of. We can, at any time reject user request for funding free from discretion.

Prestige may send periodic  informational emails to Users. You may opt-out of such communications at any time by following the opt-out instructions contained in the e-mail or by contacting us at .

3.3 Code Of Conduct

Attitudes to Funding:

Prestige does not tolerate impolite, rude and/or unseemly behaviour. This behaviour may forfeit future business relations.

Complaints Procedure

We reserves the right to investigate complaint(s) or reported violation(s) of this Agreement. Prestige may take action it deems appropriate including but not limited to reporting any suspected unlawful, activity to law enforcement officials, regulators or other third parties. This includes the breaking of this Agreement by disclosing any information to non affiliated parties (individual or Website) of Prestige. Also, including but not limited to: Funder theft of client capital, copying of confidential materials belonging to Prestige and their group. Any any attempts of money laundering.

Any complaints about Prestige will be investigated thoroughly. You can do so by contacting us directly though this website.

3.4 Copyright Notice

3.6 Limitation of Liability, Limitation of Warranty and Indemnification

The liability of Prestige Capital Partners under on in connection with this Agreement shall be limited to the extent possible by the Governing law.

Our Website and connected services are provided on an  “AS IS”, “with all faults” and “currently available” basis. The risk to the satisfactory performance, quality and accuracy is with the Financial Provider. Prestige does not make representations or warranties under this Agreement of Third Party promotions. All representations and warranties of Prestige under or in connection with this Agreement are excluded to the extent legally possible. Please note:

  • Information provided by Financial Providers  determined by their satisfactory to the accuracy, adequacy and completeness. It is your responsibility to discover and complete investigations into any deal promotion or financial offering.(Please refer to Article 1. Disclaimer)
  • Prestige may recommend Financial Providers and/or investment opportunity
  • There may be errors of deficiencies in the information provided by Financial Providers which we strongly recommend seeking further information or legal advice prior to any transaction.

The Website User agrees that:

  • The TC is a legal, valid, binding and enforceable document against the Website User
  • The Website User to observe applicable laws and regulations in the Terms of this Website and the Code Of Conduct expressed herein.
  • Deals provided by the Financial Provider are consistent with the laws applicable to the laws and regulations of their country
  • Information described for each Deal must be accurate, non – misleading and complete.

The Website User shall indemnify and defend to the full, true extent permitted by HK law against any cause of action, liabilities, losses, cost of expenses (including Fees and expenses of legal council) with respect to any claim by Third Parties arising out of Website Users’ failure to perform it’s obligations under their Agreement. Prestige Capital Partners can not be held responsible for Financial Provider misleads and misdeeds.

3.7 Force Majeure

No Party shall be liable to the other if performance of any of its obligations is prevented, hindered, or delayed by the occurrence of circumstances beyond its control. Circumstances shall include, but shall not be limited to, any act of God, act of any Government or other statutory undertaking, industrial dispute beyond the area of control of such Party. We are not responsible or under no control of anything that constitute a force majeure event, i.e., are beyond the control of the Party invoking it. Force Majeure events include non responsibility as a result of the failure of such Party to perform any of its obligations under the Agreement.

Following the occurrence of any such event the Party thereby affected shall notify the other Party in due time of such occurrence and such Party shall use its reasonable endeavors to overcome or to minimize the adverse effects thereof.

Performance of the affected and related obligations shall be postponed for a period equal to the time lost by reason of the delay. If as a result of force majeure a Party is rendered definitely unable to perform, or if the period of force majeure has lasted longer than three months or as soon as it is reasonably clear that it will last longer than three months, the other Party may, with immediate effect, terminate the Agreement in writing.

3.8 Modifications of the Agreement

Prestige Capital Partners reserves the right to modify the Agreement at any time, without giving reason. We shall give prior notice of any modifications of the Agreement on the Site, held for 2 days.

3.9 Miscellaneous And Account Termination

The Parties agree that, in the event of any disputed or unresolved claim, debt or obligation, Prestige will seek arbitration via legal assistance.

Website Users shall not assign or transfer any of its rights and obligations under this Agreement without our prior written consent. The Agreement constitutes the entire Agreement between the all Parties with respect to the subject matter of the Agreement.

Should any provision of the Agreement be invalid or unenforceable, the remaining provisions shall be valid. In the place of an invalid provision, a valid provision is presumed to be agreed upon by the Parties, which comes economically closest to the one actually agreed upon. All disputes arising out of or in connection with the Agreement shall be governed by Hong Kong law excluding the conflict of law rules and the Laws in treaties. Failure or neglect by us to enforce any of the provisions of this Agreement shall not be construed or deemed to be a waiver of Prestiges’ rights.

All disputes arising out of the Agreement or in connection with the Third Party activities shall be solely in discretion of those Parties. The place of arbitration shall be in Hong Kong. The court of arbitration shall conduct the proceedings and all awards shall be rendered in the English language.

The Agreement shall take effect if our client wishes to not proceed with Prestige Capital Partners services. Therefore under this article,  client must ask Prestige to remove the details it hold on database to be fully removed and must be made clear in writing or in Email.

4.0 Fees And Costs

The Client acknowledge the fees (herein “Fees”) payable to Prestige Capital Partners (HK) LTD are indicated on the Fee Agreement  as they become due. Prestige will not specify the timing of funding completion but will disclose fee amount at the earliest opportunity as and when the Fee Agreement has been offered. Fees vary between User / Client and Funder(s). The Fees include all related taxes (hereinafter “Taxes”).

Prestige Capital Partners cannot hold client monies by law. All Fees are included in the Financial Providers Terms so Prestige is not responsible there of. Prestige Capital Partners may not be able to refund, credit or supply vouchers to the client. Prestige has the right to change the costs at any time. You, the Client are responsible for paying back the loan in full with the interest specified by the lender. Prestige do not charge any upfront fees and any fees payable to Prestige will be upon successful completion of funding. Prestige does not take any responsibility for any fees which may be levied by its funders. Prestige has the right to inform the funder of any fee agreement between Prestige and the client.

4.1 Taxes

Each Party will pay Taxes now or hereafter imposed by law on the respective Party unless otherwise provided by the Agreement. Prospective investors must rely on their own examination of the legal, taxation, financial and other consequences of investing before making the application, and then only having read fully the Information Memorandum  including any risks involved. They should not treat the contents of this document as advice relating to legal, taxation or investment matters and they are advised to consult their own professional advisers.
